US Senators Propose Bill to Combat Nonconsensual, Sexual Deepfakes

A bipartisan group of US senators introduced a bill on Tuesday that seeks to criminalize the distribution of nonconsensual, sexualized images created using artificial intelligence. The measure is a direct response to the recent proliferation of pornographic AI-generated images of Taylor Swift on various platforms.

Under the proposed bill, victims who appear in nude or sexually explicit 'digital forgeries' can seek civil penalties against individuals who produced or possessed the forged content with the intent to distribute it, as well as anyone who knowingly received and shared the material without consent.

The Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2024, also known as the 'Defiance Act,' is supported by US Senate majority whip Dick Durbin, as well as senators Lindsey Graham, Amy Klobuchar, and Josh Hawley.

Addressing the Harm of Deepfake Images

Durbin expressed the impact of deepfake images in a press release, stating, 'This month, fake, sexually-explicit images of Taylor Swift that were generated by artificial intelligence swept across social media platforms. Although the imagery may be fake, the harm to the victims from the distribution of sexually-explicit 'deepfakes' is very real.'

These AI-generated images, also known as 'deepfakes,' often go viral and gain millions of views. They can range from digitally altered videos to entirely generated content. With the rise of artificial intelligence, creating deepfakes has become more accessible, leading to an increase in their prevalence on the internet. The images of Taylor Swift were likely created using Microsoft Designer and initially shared on Telegram.

Microsoft has since made changes to address this issue and prevent the creation of such images using their software. However, the proposed bill aims to provide legal recourse for victims and hold perpetrators accountable, ensuring that no one, including celebrities, should have to endure the harm caused by AI pornography.

Swifties Take Action to Counter Deepfakes

Swifties, the devoted fans of Taylor Swift, took action to combat the spread of AI-generated deepfake images. They flooded social media platforms with tweets containing the phrase 'Taylor Swift AI' along with clips of her performances. This tactic aimed to overwhelm search results and make it more difficult for users to find the illicit images.

As the controversy surrounding the deepfakes grew, Elon Musk's social network platform, X, took measures to prevent further dissemination. Searches related to Taylor Swift were prohibited on the platform to contain the spread of the images. However, the incident led to significant repercussions within Musk's company, resulting in layoffs of employees responsible for content moderation.

The introduction of the bill and the actions taken by Swifties highlight the urgent need to address the negative impact of deepfake technology and protect individuals from nonconsensual, sexualized digital forgeries.
